LINKSMILE PUBLISHER TERMS OF SERVICE Publisher Agreement #1 - Payment: All payments from LinkSmile will be made in a timely manner by way of the selected payment option in your profile. However, we ask that you agree not to hold LinkSmile liable for customer fraud nor non-payment due to refunds for any reason. Further, LinkSmile will be within its rights to retain unpaid earnings to cover any losses incurred by fraudulent orders or refunds. After each sale, your earnings will be held for a 2-week grace period (14 days) to allow for refunds. After the grace period, we will not allow refunds for any reason other than extreme situations. At that point, your account will be credited and you can count on receiving that amount during the following round of payouts. Alternatively, should you desire immediate and direct payments upon a sale; you may sign-up for a 'Dedicated Store' once logged in. Otherwise, payouts are made each month between the 1st and 5th of the month. If your site is approved, and then you change the site layout affecting ad placement; you must notify us of the change to request re-validation. If you change your site afterwards and someone requests a refund, it will be honored -even if it is after the 5-day grace period during the paid period. This is to protect buyers from sellers who obtain sales based on being approved and then unethically change their ad spots to non-premium afterwards. The refund policy is thus: Users may request a refund within the first 5 days of payment for an order. However, refunds are only honored in the case that the site is mis-represented. Buyer are made aware of this policy. Publisher Agreement #2 - Rate of Compensation: LinkSmile agrees to compensate you for usage of your site(s) to display ad content. You will be compensated according to the payout percentage shown in your "Control Panel." If at any time, you decide not to agree to this rate; you may withdraw your sites from the inventory manually or by 'Unsubscribing' your account (done from the "Profile Area") or by making your sites inactive. You may at any time accept or deny any or all advertising. However, you agree that if you fail to approve an ad within 24 hours; we have the right to approve an ad on your behalf. However, we will not approve any ads you have specifically requested not be shown on a given site (i.e. set in the New Site Wizard).
